General Terms and Conditions
These terms and conditions apply to the following services:
Beyond IQ (KVK number 77754581) is located at Laan van Kronenburg 14, 1183 AS Amstelveen, the Netherlands (“Beyond IQ” or “we” or “us”).

These terms and conditions apply to the sale of any Online Course and/or Consultation Services. Please read these terms and conditions carefully before purchasing an Online Course and/or Consultation Services and print off a copy for your records.
For purchases via our website, by clicking on the “Accept” button you agree to the terms of this agreement which will bind you. If you do not agree to these terms and conditions, you must cease to continue to purchase any Services from us.
1. Definitions
- “Confidential Information” means the information provided by one party to the other in written, graphic, recorded, machine-readable, or another form concerning the business, clients, suppliers, finances, and other areas of the other party’s business or products, including, without limitation, the Course Materials, but does not include information in the public domain other than through the default of the party disclosing the information, information required to be disclosed by any court or regulatory authority, or any information already in the possession or control of the disclosing party.
- “Course Materials” means the information provided by Beyond IQ to accompany a course provided as part of the Services in electronic form or hard copy.
- “Fees” means the fees paid by you to Beyond IQ for the Services.
- “Intellectual Property Rights” means copyright, rights in or relating to databases, patent rights, performers’ rights, designs and registered designs, trademarks, rights in or relating to Confidential Information, and other intellectual property rights (registered or unregistered) throughout the world.
- “Online Course” means the delivery by us of an online workshop according to which you learn course materials remotely. It is purchased by you online through the Website.
- “Consultation Services” means the delivery by us of a consultation session to which you receive advice in a one-on-one, online or in-person meeting. It is purchased by you online through the Website.
- “Services” means the provision of the Online Course and/or Consultation Services together with such other services as agreed upon from time to time and purchased by you through the Website.
- “Events” means a workshop taught by us in a webinar or in person.
- “Website” means beyond-iq.com, the online shop website, and terms & conditions.
- “You” or “Client” means the individual purchasing the Services.
- “Agreement” means entering a mutual consent about the Client’s purchase of the Online Course and/or Consultation Services provided by Beyond IQ.
2. The Services
2.1. A description of the Services together with the dates on which the Services will begin are available on our Website. We will provide the Services with reasonable care and skill in accordance with the description set out on the Website.
2.2. We reserve the right to vary or withdraw any of the Services described on the Website without notice.
2.3 We expect you to confirm that the Services you are purchasing will meet your needs. We do not make any guarantee to you that you will obtain a particular result, professional qualification, or employment opportunity from your purchase and completion of any of the Services.
3. Ordering Services and Confirmation
Purchasing Services via the Website
3.1. To purchase any of the Services online, you must register for an account with us via the Website. If you already have an account with us, you can log into your account using your username and password.
3.2. When you place an order for a Service via the Website you are offering to purchase the Services on these terms and conditions. Beyond IQ reserves the right to cancel or decline your order or any part of your order at any time until it has been confirmed in accordance with clause 3.4 below.
3.3. Following receipt by us of your order for Services via the Website we will contact you confirming receipt of your order.
3.4. A legally binding agreement between us and you shall come into effect when we have:
- accepted your offer to purchase Services from us by sending you an email confirming the purchase; and
- received payment of the relevant Fees from you in accordance with clause 5 below.
3.5 Where your order consists of multiple Online Courses or Additional or Sequent Study Materials (see clauses 6), each individual course will be treated by us as a separate offer to purchase. Acceptance of your offer to buy one or more courses will not be accepted by us of your offer to purchase any other courses which make up your order.
3.6. We reserve the right, in our sole and absolute discretion and without the need to give a reason, to refuse to accept an offer to purchase one or more Online Courses. In such circumstances, no contract will arise, and we will return any payment accompanying your purchase offer.
4. Cancellation and Variation
4.1. Subject to clauses 4.2 and 4.3 below, where we have accepted/confirmed the Services being purchased by you and formed a legally binding agreement with you in accordance with clause 3.4 above, then you are permitted within 14 working days starting on the day after the date we have concluded our agreement in accordance with clause 3.4, to cancel your purchase of the Services.
4.2. If you have purchased an Online Course and have already accessed, downloaded all or part of the Online Course and/or started to use that Online Course, then you shall have no right to cancel your order.
4.3. If for any reason, you need to cancel/reschedule a Consultation Service, you will need to provide us with at least 24 hours’ notice. Any cancellations with less than 24 hours notice are chargeable for the full session fee. Being unavailable for any session without informing us will also incur the full fee for the session you have booked. If you decide to cancel 24 hours before, you have the flexibility to reschedule the session or cancel the session.
4.4. Notwithstanding clause 4.1 there is no other right to cancel or vary your purchase of Services, and any other cancellation and / or variation of course dates will be at the entire discretion of Beyond IQ.
5. Fees
5.1 Your booking(s) will not be confirmed until the payment is received by Beyond IQ.
5.2 All Consultation Services that have not been scheduled within 12 months from the date of purchase will expire.
5.3 All online courses are available to you for an unlimited time.
5.4 Special offers may only be available for a limited time and can be withdrawn at any time.
5.5. The Fees for the Services shall be as set out on the Website or as told to you over the phone at the time you placed an order for them.
5.6. Unless otherwise specified at the time you purchase the Services the Fees are inclusive of VAT or other local taxes.
5.7. Fees for the Service selected by you on the Website shall be debited from your credit/debit card at the time of purchase. Fees must be paid in full prior to you attending/receiving any Service.
5.8. Any fees charged by your debit or credit card provider in connection with your purchase of Services are for your own account and Beyond IQ shall not be responsible for these.
5.9. You shall be responsible for all costs in connection with your attendance at any Consultation Services or your access to any Online Course.
6. Additional or Sequent Study Materials
6.1. Additional or Sequent Study Materials may be available as an add-on or sequent course to an Online Course and may be bought separately. Additional or Sequent Study Materials are payable for such additional services to you.
6.2. Any payment for Additional or Sequent Study Materials (if applicable) and any delivery charges payable in relation to the delivery of Additional Study Materials, if applicable, will be accepted by the same methods as set out in Clauses 5 above.
7. Liability
7.1. No part of the provision of the Services shall be deemed to be, nor is it intended to be, nor should it be taken to be, the provision of investment advice.
7.2. Although Beyond IQ aims to provide Services to the highest standards of the industry, neither it, nor its trainers accept any liability for (i) any inaccuracy or misleading information provided in the programs or Course Materials and any reliance by Client on any such information, (ii) any loss or corruption of data, (iii) any loss of profit, revenue or goodwill, or (iv) any indirect, special or consequential loss arising from any breach of the terms of this Agreement.
7.3. Except to the extent that they are expressly set out in these terms and conditions, no conditions, warranties, or other terms shall apply to the Services. Subject to clause 7.5 no implied conditions, warranties, or other terms apply (including any implied terms as to the satisfactory quality, fitness for purpose, or conformance with description).
7.4. Subject to clause 7.5 below, Beyond IQ’s total liability arising from or in connection with these terms and conditions and in relation to anything which we may have done or not done in connection with these terms and conditions and the delivery of the Service (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the Fees received in connection with the relevant Online Course or Taught Course in relation to which a dispute has arisen.
7.5. Nothing in this Agreement shall exclude or limit Beyond IQ’s liability for (i) death or personal injury caused by negligence, (ii) fraudulent misrepresentation, or (iii) any other matter which under Dutch law may not be limited or excluded.
7.6. No claim may be brought more than six months after the last date on which the Services concerned have finished or ceased to be provided by us.
8. Intellectual Property
8.1. All Intellectual Property Rights in the Course Materials, Online Courses, and the speeches made by trainers at the Taught Courses are, and remain, the intellectual property of Beyond IQ or its licensors, whether adapted, written for, or customized for the Client or not.
8.2. You are not authorized to: –
(i) copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission.
(ii) record on video or audio tape, relay by videophone or other means the Online Course or Taught Course given.
(iii) use the Course Materials in the provision of any other course or training whether given by us or any third-party trainer.
(iv) remove any copyright or other notice of Beyond IQ on the Course Materials.
(v) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.
Breach by you of this clause 8.2 shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services, including but not limited to access to the Online Courses.
8.3. Depending on the nature of the violations, penalties may include civil damages in Euros sum of damages and lost profits, an injunction to stop the infringement, payment of the attorneys’ fees by the infringer, and felony charges with prison time.
8.4. In consideration of the Fees paid by you, we grant you a limited, non-transferable, non-exclusive license to use the Course Materials for the sole purpose of completing the Online Course.
9. Confidentiality
9.1. Upon providing contact details, accepts the Client to be contacted for marketing and promotion purposes. The Client has the right to subscribe from being approached by informing Beyond IQ via email or by phone.
9.2. Each party shall keep the other party’s Confidential Information strictly confidential and not use it otherwise than for the purposes of these terms and conditions and shall return it on demand and not retain copies of it.
9.3. Either party may disclose Confidential Information to its legal and other advisors for the purposes of obtaining advice from them.
9.4. This clause shall continue notwithstanding termination of these terms and conditions.
10. Termination
10.1. We shall be entitled to terminate these terms and conditions and cease to provide you with any Services with immediate effect if you:
- fail to pay when due your Fees.
- act in an aggressive, bullying, offensive, threatening, or harassing manner towards any employee of Beyond IQ, any teacher or lecturer who provides the Taught Courses, or any student who attends any Taught Course.
- cheat or plagiarize any work which you are required to prepare or submit in connection with the Services or during any examination taken in connection with the Services.
- steal or act in a fraudulent or deceitful manner towards us or our employees or any other students who may be on our premises or attending our Taught Courses.
- intentionally or recklessly damage our property or the property of our employees or other students attending our premises.
- commit any criminal offense committed on our premises or where the victim is our employee or student.
- are in breach of these terms and conditions.
10.2. On termination clauses 7 (liability), 8 (intellectual property rights), 9 (confidentiality), and 10 (termination) shall continue notwithstanding such termination.
11. Assignment
Any Services provided by us under these terms and conditions are personal to you and cannot be transferred or assigned to any other person.
We shall be entitled to assign these terms and conditions to any other company without prior notice to you.
12. Entire Agreement
These terms and conditions are the entire agreement between the parties and supersede any prior agreements and arrangements, whether written or oral. You confirm that you have not relied on any representations in entering these and any other terms and conditions with us. Nothing in this clause or terms and conditions shall limit liability for any fraudulent misrepresentation.
13. Force Majeure
Beyond IQ shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, pandemics, floods, earthquakes, volcanoes, and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer, Government edict or regulation.
14. Assignment
We may assign, transfer, or subcontract any of our rights or obligations to any third party at our discretion.
15. Data Protection
15.1 The nature of the Services provided by us means that we will obtain, use, and disclose (together “Use”) certain information about you (“Data”). This statement sets out the principles governing our Use of Data. By purchasing the Services, you agree to this Use.
15.2 When you register with us you will need to provide certain Data such as your contact details and demographic information. We will store this Data and use it to contact you, and provide you with details of the Services you have purchased and otherwise as required during the normal provision of the course.
15.3 We may also use the above Data, and similar Data you provide us in response to surveys, to aggregate user profiles and, unless you click on the relevant button on the Registration Form, provide you with communications. We will not pass any personal data on to anyone outside of Beyond IQ.
15.3 To enable us to monitor and improve our Services, we gather certain aggregated information about you, including details of your operating system, browser version, domain name, IP address, the URL you came from and go to, and the parts of the Website you visit.
15.4. We use information such as your User ID, session identifiers, and password to enable us to identify whether you are using our services, assist with the provision of services, and ensure that you have access to relevant products. We will only read cookies (if applicable) from your cookie file placed there through your web browser’s interaction with the Website.
15.5. Our products may link to third-party websites, and we are not responsible for their data policies or procedures or their content.
15.6. Beyond IQ endeavors to take all reasonable steps to protect your personal Data including the use of encryption technology but cannot guarantee the security of any Data you disclose. You accept the inherent security implications of being and transacting online over the internet and will not hold us responsible for any breach of security.
15.7. Beyond IQ may supplement the information that you provide with information we receive from third parties, such as exam registration bodies or your employer.

16. Law and Jurisdiction
This Agreement is subject to Dutch law and the parties submit to the exclusive jurisdiction of the courts of the Netherlands in connection with any dispute hereunder.

International Schools Network For Underachievement
- Seat
The International Schools Network for Underachievement’s seat is in Amsterdam, the Netherlands.
The Network is powered by Beyond IQ. All terms and conditions of Beyond IQ apply to the Network’s activities.
2. Purpose
To bring together international school educators to connect, learn and share practices to meet the needs of underachieving students within a regular classroom.
3. Membership
a. Acceptance of Terms and Conditions
i. Membership of the International Schools Network for Underachievement (also called ISNU) is conditional on acceptance of these terms and conditions. These may be subject to change, and we shall not be obliged to notify you personally of any changes so please refer to newsletters and the ISNU social media for notifications of changes that may affect your membership. By applying for membership, you are accepting these terms and conditions.
b. Application for Membership
i. Any educator can apply. We reserve the right to deny membership and refuse access to our meetings and events or online facilities. We shall not be obliged to provide an explanation for such refusal and are not liable for such action.
ii. Admissions are made online, and by submitting and purchasing a yearly membership you are deemed to have accepted such terms and conditions.
c. Membership Fees
i. Our membership fees are annual and can be paid securely through our website. Our membership system will send reminders when your membership is due to be renewed. You can contact us via email when you receive your renewal notice to renew your membership. Please ensure you keep your membership account email address details up to date, even if you change your business.
ii. Fees are stated on our website and are subject to change without prior notice. Renewal fees are set by ISNU and are set at our discretion. You are not obliged to renew your membership.
iii. ISNU operates a non-exclusive, open to all policy. There is no limit on members from the same organization attending. There is no minimum or maximum number of meetings for attendance.
iv. Yearly membership is individual. It is not allowed to share or transfer the membership credentials with any other person. For your own safety, we kindly ask you not to share your login details with others.
d. Monthly workshops
i. The monthly online workshops take place online via Zoom and are subject to alteration without prior notice. The ISNU may have to cancel workshops due to factors outside our control. We will endeavor to make every effort to avoid this and notify members, but we will not be liable under any circumstances for any cancellation. If a speaker who is booked for a special event does not attend, ISNU will not be liable for such non-attendance.
ii. All members receive the workshop recordings within 5 business days of the event day. Subject to intellectual property law, it is not allowed to share these workshops or materials with any other individual.
iii. Members agree to comply with all health and safety regulations and policies of all host venues.
iv. The ISNU is entitled to use photos from the monthly workshops for marketing purposes on social media and Beyond IQ’s website. In case you would like to remove a photo or footage that you appear in, please send an email to the administrator or info@beyond-iq.com informing us of the photo/footage’s location.
v. Members who run networking groups that may conflict with ISNU or whose networking activities are deemed to be in competition with ISNU, may not promote these groups or networks without express written permission from the Directors. The Directors reserve the right not to give this permission and no explanation may be forthcoming.
e. Consultations
i. Each member is entitled to three online consultations per academic year with Lihi Engelsman. These consultations can only take place between the months of October and June of the same academic year. The consultations are non-transferable, non-refundable, and non-accumulative and renews every year academic year.
ii. A booking of consultation will be made via a particular link that will be sent to all members of the ISNU.
iii. When booking a consultation, members are required to contact ISNU at least 24 hours in advance if they can no longer attend a meeting previously booked. If the member is deemed to be a ‘no show’ (i.e., they have not turned up and have no warning or explanation within a reasonable time frame after the event is received), this could affect their entitlement to book future consultations. Two “no-shows” consecutively will cancel the member’s entitlement to book the third consultation.
iv. Members who book a consultation need to fill in a form that will be sent to them via email. Without completing the form, it would not be possible to meet at the designated time, and the consultation will be canceled. In that case, it will still count as attending the consultations.
f. Cancellation
i. Membership is an annual term, and no fees are refundable after the first month of the first-time membership.
ii. It is possible to cancel the membership during the first month of network activity (i.e., October 2023) and receive a full refund if you cancel by October 31st, 2023, by 23:59).
iii. It’s possible to join during the entire year. The network workshops are recorded and are available to all members for the entire membership duration.
iv. If an admin payment fails, then we will invoice for the remaining balance and an admin fee may also become payable. Failure to do so may result in a new year term being entered into. Any adjustment after that date will be subject to an admin charge.
v. ISNU may terminate your membership at any time if your conduct does not fit with the ethos of ISNU. No refund shall be given in such a case, and we shall not be obliged to give you a reason for such a termination. In such a case all your details will be removed from our website. And we shall withdraw all other benefits.
g. Data Protection and Intellectual Property
i. We will respect the information you give us in accordance with the Data Protection Act 1998 and GDPR. You agree that it is your responsibility to keep your data accurate and up to date. We will use your data to administer your membership.
ii. The events, workshops, and materials are offered to members only and are the intellectual property of Beyond IQ. They are non-transferable for the mere usage of the members. It is not allowed to make any private or commercial use of them without the written permission of Beyond IQ or Lihi Engelsman. Illegal usage of the materials may lead to legal prosecution and fines under the law of intellectual property.
h. Governing Law
i. These terms and conditions shall be interpreted in accordance with Dutch law and all disputes shall be subject to the jurisdiction of the Dutch courts.
